General Terms & Conditions for the Sale of Digital Content and Photographs

What We Sell

  1. Digital content – photo presets, online courses, e-books and similar files (.lrtemplate, .dng, .mp4, .pdf, etc.).
  2. Photographs – artistic works offered for download.
  3. Gift vouchers – electronic or printed.

How a Contract Is Formed

  1. Order – add the product to the cart, fill in your details and click “Order with payment obligation.”
  2. Confirmation – the contract is concluded the moment we email our order acceptance, or when you pay the price / download the file, whichever comes first.
  3. Language – the contract is concluded in Czech unless we expressly agree otherwise.

Price & Payment

  1. All prices are final – VAT and all fees included.
  2. Payment methods:
    1. Card / instant bank transfer (recommended, immediate access),
    2. Standard bank transfer (access after funds clear),
    3. Cash on delivery – for physical shipments only.
  3. For orders over CZK 5,000 we may request a deposit or full pre-payment.

Delivery

  1. Digital content is available for download or streaming immediately after successful payment.
  2. Physical goods (if offered) are dispatched within 5 working days; choose the carrier in the cart.
  3. Shipping costs are always shown before you submit the order.

No Returns on Digital Content

  1. Downloaded once = non-returnable. Digital products are intangible and protected by copyright; once delivered they cannot be “returned.” We therefore offer no refunds or exchanges.
  2. Explicit consent. Before paying you give consent to immediate delivery of the digital content and acknowledge loss of the 14-day withdrawal right under Sections 1829 & 1837 (l) of the Czech Civil Code / EU Directive 2011/83/EU.
  3. Technical defects. If a file is damaged or won’t open, email support@eliskajanous.com within 30 days of purchase. We will provide a working copy free of charge. This covers technical functionality only, not satisfaction with the content.
  4. Gift vouchers are non-refundable and cannot be exchanged for cash.

Withdrawal (Physical Goods Only)

This article does not apply to digital content.

  1. A consumer may withdraw from a contract for physical goods within 14 days of receipt without giving a reason. Email us at support@eliskajanous.com or send a letter. Returned goods must be undamaged, complete and preferably in the original packaging. Detailed instructions and a template form are available on our website.

Defective Performance (Claims)

We follow the Czech Civil Code (§ 1914–1925, 2099–2117, 2158–2174).

  1. Digital content – see Art. 6 (technical functionality).
  2. Physical goods – defects must be reported without undue delay, no later than 24 months after receipt.

Personal Data Protection

  1. Your data are processed in accordance with GDPR and Czech Act 110/2019 Sb.
  2. The data controller is the Seller (see Art. 1).
  3. We use data only to fulfil orders and for marketing you can opt out of at any time.
  4. Details are set out in our Privacy Policy on the website.

Copyright & Licence

  1. Purchasing digital content grants you a non-exclusive licence for personal use.
  2. Any further distribution, sale or publication without our written consent is prohibited and may be penalised under copyright law.

Cookies & Analytics

  1. Our site uses cookies (including Google Analytics) to measure traffic and improve services. You can disable cookies in your browser, but some functions may then be limited.

Final Provisions

  1. All legal relations are governed by the law of the Czech Republic.
  2. Invalidity of any part of these terms does not affect the validity of the remainder.
  3. We archive these terms electronically and will email them to you on request.
